Conversation with JAG

After speaking with Cadet Carlyle, Kyle tapped his desk comm and said, "Commander Reece to Lieutenant Triannth." He then waited for her reply.

Serenity was cleaning up her office after the attacks when the call came through. "Yes Commander Reece?" She replied. "What can I assist you with?"

When Kyle heard Serenity's voice, a soft smile crossed his face. "Serenity, I've got a case for you, the possible charge being conduct unbecoming an officer of Starfleet. Possibly a couple more, but I'll leave that for your consideration."

There was a pause. "Who?" She finally asked. This was going to be a mess she knew, without even knowing who the charges may be levelled against.

Kyle let out a resigned breath. "Savar," he said simply, as there was only one individual aboard by that name. "Apparently, during the recent attack, after witnessing one of the cadets being killed, he....for lack of a better term, forced another crewmembers, and her two children, into a Jeffries tube. He then sealed it behind them, abandoning a group of cadets that were under assault from the creatures that boarded the ship. I have several statements and signed affidavits swearing to the validity of the charges." Ge paused to take a breath, then continued.

"I am sending you the information that I have now. You will find the interviews to be original, untampered footage. Once you have a determination that the case if valid, then I shall take Savar into custody."

Serenity watched as the information filled her console screen. "Oh this is not good." she said her voice soft. "I will call you back."

"Understood. Talk soon, Reece out." He then closed the channel and continued with his duties.

An couple of hours later she called him back. "Commander Reece, I hope you are sitting down."

Kyle didnt like the sound of her voice, so he sat back in his desk chair. "Go ahead, Serenity."

"The charges... are as follows: Under Article 12, Section 5 – Dereliction under combat conditions. Article 21, Section 2 – Assault on a Fellow Officer. Article 18, Section 7 – Reckless Endangerment of Subordinates and Article 14, Section 3 – Conduct Unbecoming a Starfleet Officer. " She said into the comm. "Sending the list now. I am assigning LT JG Caden Tharos as Lieutenant Commander Savar cha'Salik hei-Surak Talek-sen-deen's JAG Defence Counsel."

A heavy sigh escaped Kyle's chest as he listened to the gathered charges. He then spoke up. I knew it was going to be bad, but shit." He then paused a beat before asking, "Regarding the charge of assault on a fellow officer...why is that in there?"

"Physical force used on another officer. He pushed the Lieutenant into the Jefferies tube. While we have no complaint from her about it, it is a matter of record."

Kyle nodded in understanding. "Alright. Though, that one might end up getting dropped." He inhaled and then exhaled sharply. "Looks like its time got me to go take him into custody. Have you informed the Commodore and XO?"

"No not yet" Serenity replied. "Do you wish to do so?"

Kyle sighed softly. "Yeah. I'll do do as soon as we end this communication."

"Let me know and I will send Caden down to the Brig to meet with his client." Serenity said softly. "By the book Commander. Lets not have a repeat of Lia Taylor."

Kyle nodded as he stood. "Alright. I'm heading out to place him in custody. I'll reach back out to you afterwards." He closed the channel, then made his way out to the main office area of the security department.

Looking around the space, his eyes first landed on Damien. "Blackford," he called out as he started towards the exit. "You're with me."

Damien looked up from the Console he’d been working on, in the middle of running routine checks on the Phaser Banks, when he heard his name being called. Glancing around, he gestured to one of the other crew members who was nearby. “Can you finish this for me?” He asked, before quickly moving to catch up with the Commander.

“Is everything okay Commander?” He asked, marching a few steps behind. Something about Reece’s demeanour told him he wasn’t going for a standard patrol.

Kyle didn't reply at first. The two men made their way to the nearest turbolift and entered. When the doors slid shut, Kyle finally spoke. "Computer, hold transport." He then looked at his junior officer, the mixed emotions clearly visible in his eyes. "One part of the job that I will never enjoy, is arresting a fellow officer." He paused, then continued. "We are arresting Lieutenant Commander Savar this morning. The charges are many, but boil down to conduct unbecoming during the battle, where he abandoned a group of cadets to the intruders. Those cadets could have been killed, had other officers not arrived."

He took another breath, then check on Savar's current location. He then ordered the turbolift to proceed. "As the senior officer present, I'll make the arrest, Damien. You are here only as required backup. Do not speak to the commander unless instructed, understood?"

When they stepped into the turbolift and Reece immediately called for its halt, Damien looked over his Commanding Officer, questions rising on his lips, that died as soon as Reece started talking. At the mention of arresting a fellow Officer, Damien’s brow furrowed in confusion, which was soon replaced by a look of shock. He knew that in the heat of battle, men sometimes did things that they never normally would, but to completely abandon anyone, let alone Cadets with little to no experience, he couldn’t believe anyone would do that.

As the turbolift started moving once again, Damien looked at Reece and swallowed the lump that had formed in his throat. Nodding, he said, “Aye Sir. understood.” As they headed towards their destination, he quickly started mentally going over the protocols and regulations that were required for the task ahead.

A few moments later, the two security officers were standing outside Savar's office. Kyle paused a beat, then reached up and pressed the door chime.

Savar had just finished seeing a patient when the door chime sounded. "Enter." He called out. As the door slid open to reveal Kyle and Damien standing there. "Commander Reece, Lieutenant Blackford. This is unexpected. How may I assist you?"

Damien stepped inside the room, following after Commander Kyle, taking postion by the door, keeping his arms folded behind his back, his chest tightening as he thought about the situation about to unfold, and just hoping that Savar would have the good sense to come along without issue.

Kyle paused a beat, still not enjoying this part of his job. "Lieutenant Command Savar," he began with a professional demeanor. "Following the recent attack, you have been charged with several serious charges, namely, conduct unbecoming a senior officer during combat." He paused to take a breath and allow the fhatge to sink in with the Vulcan officer. "After a thorough investigation, the decision has been made to take you into custody, to face a court martial for your actions." He lifted the cufs he was carrying and opened them.

"I hearby notify you, that you are under arrest. You have the right to remain silent. Anything you say can, and will, ve used against you during your court martial. You have he right to legal council. You ma ether choose your council, or the J.A.G. with appoint one for you. He reached out and started placing Savar's wrists in the open cuffs as he spoke.

"Do you understand these rights as I have sa them?" Kyle asked as he started to close the cufs.

Savar's outward appearance didn't change except for a slight stiffening of his back and narrowing of his eyes. He searched his memory of when he had acted unprofessionally and came up blank. All he could think of was his time with Heather and her children. He looked at Kyle. "I understand. I will speak with counsel." He replied simply, calmly and evenly and to the point. His eyes drifted to the cuffs but he made no attempt to avoid them.

Nodding professionally, Kyle finished securing Savar's wrists in the cuffs, the took gold of his right elbow. "Thak you for your cooperation." He then escorted Savar out of his office, with Damien in tow, and the three men took the most direct route back to the security department, and to the brig.

As Kyle placed Savar into a cell, he said, "Regulations state that all detainees are o be brought to the brig. It's up to J.A.G. ass to whether you remain here, or are sent to your quarters for house arrest." He removed the cuffs and stepped out of the cell, the forcefield activating automatically. "I will put in my report that you came without conflict, Savar. For now, have a seat and I'll notify J.A.G. that you wish to speak to council."

Savar mentally winced as the cuffs were locked about his wrists and the trio headed to the brig. he kept his gaze focused straight ahead on the journey never looking to the right or left. Thankfully they encountered very few of the crew on the way.
Once in the cell, he stepped back and looked at Kyle. "I would prefer house arrest as I am no flight risk having my wife and family here. I will await my counsel to arrive."

The doors opened and a Lieutenant walked in. "Lieutenant JG Caden Tharos, JAG Counsel for the Commander."

Kyle looked over at the young lieutenant and nodded. "Good timing. Your client is in the first cell on the left." He moved to step in front of Tharos, looking down at the younger man with a stern look. "You need to be scanned first, to ensure you are not carrying any concealed weapons." He said it both sternly, and with the tone of someone who knows his job and the rules.

Caden nodded and let the scan go ahead. "What is his mental state like?"

Kyle pulled out his tricorder and ran several close scans of Caden and his briefcase. A few beats later, he closed the device and put it away, nodding to the young officer. "You've got twenty minutes, Counselor." He then stepped aside and allowed her entry to the cell block.

Damien kept his position near the entrance to the brig, arms folded behind his back, keeping a close watch on the young Lieutenant as he made his way to Savar's cell.

Savar sat on his cot as Caden approached the entrance to the cell. He stood and walked to the front and stopped just short of the forcefield. His eyes taking in every inch of Caden. He was young with alert eyes without being arrogant. He had a confident air about him. "Counselor." Savar spoke evenly.

Kyle moved over to Damien and spoke quietly. "Twenty minutes, no more. Contact me immediately if there are any issues." He patted the young officer on the left shoulder, then left the brig, returning to his office to complete the arrest paperwork.

Damien nodded, looking up at the Commander. “Aye sir. Twenty minutes.” He repeated back to him, looking up at the clock on the wall, and starting an internal countdown.

=Brig Cell=

Caden hit the privacy settings and turned to Savar. "Nice pickle you have yourself in Commander. Lets see about trying to get you out of it without you ending up in here for the rest of your life."

Savar met Caden's gaze evenly. "You have a gift for understatement Counselor though I share your desire and sentiment to leave here both in the short term as well as permanently. I have no desire to be a guest here, My wife and family are onboard and I would much prefer house arrest as I am not a security or flight risk."

Caden nodded "Be that as it may Commander, the charges against you are quite... sever." He took a breath "And on that alone it may not happen"

Savar took a deep breath and closed his eyes, reopening them a few seconds later, "I am aware of the charges against me Counselor, it is why you are here to represent me. I have served Starfleet loyally and faithfully for many years without any issues. Surely, that should count for something. I repeat, being with my family and close to their support will help me mentally."

Caden nodded. "Then let's us review each charge and work out how to get you back home."
