CHAPTER I : GENERAL PROVISIONS ON LONIAN-KAVAI ALLIANCES
Implementation of the Convention shall be conducted under the supervision and jurisdiction of the Head of the Fourth House of Defense and Security.
1 DEFINITIONS
(1) The following definitions apply to this Chapter –
coercion means a threat, manipulation, force, or any form of pressure applied to an unwilling party, where such acts deprive the unwilling party of a voluntary choice.
Kavai means any person holding Kavai citizenship or allegiance, or bears the dermaglyph recognised by the Lonian government as a genetic feature of the Kavai;
person means an individual who has complete biological development and is capable of full legal agency;
Lonian means any person holding Lonian citizenship, through birth or naturalisation as recognised by the Head of the First House of Administrative Affairs;
relationship means any inter-personal connection between two persons, including but not limited to:
(a) Romantic: a connection based on love, affection, or romantic involvement;
(b) Familial: a connection of legal kinship, such as parent-child, sibling, or other familial connections;
(c) Professional: a formal or informal connection in a working, business, or vocational capacity;
(d) Friendship: a non-romantic connection, usually formed from social connection or shared interests; and
(e) Mentorship or Guardianship: a formal or informal connection where one person provides guidance, protection, or support to another in an educational or protective capacity;
Sovereignty means the Lonian Royal Sovereignty, the Lonian government comprising of the four Houses and their courts;
2 PERSONAL RIGHTS
(1) Fundamental rights granted to persons in accordance with Lonian law are –
Right to Informed Arrest. Also called "Arresting Rights." Upon arrest, the arresting officer must inform the accused of the alleged charges. This warning informs the accused that they have:
protection from self-incrimination under Civic Code 47.0.1;
the right to due process under Civic Code 29.6.11; and
the right to fundamental preservation of life.
Right to Contest Charges. The law operates under "guilty until proven innocent" (Civic Code 441.23.6). To provide fair and equal due process, the accused shall have the opportunity to present evidence supporting a not-guilty verdict.
Right to Life. All detainees must be provided sustenance at regular intervals and medical care as needed to preserve life.
Right to a Documented Process. All parts of the judicial process must be documented and shall be made available to detainees upon request.
Right to Sovereign Adjudication. Detainees are entitled to a fair and unbiased verdict under Lonian Law. The Head of the Fourth House of Defense and Security retains sole authority to adjudicate offenses and impose punitive sanction.
ARTICLE I
The Convention reflects the risk to national security posed by Kavai governance as recognised by the Sovereignty.
Section I : Whoever, owing allegiance to the Sovereignty, levies war against the Sovereignty or is found to by providing aid, comfort, and/or affiliation to the Kavai within the Sovereignty or elsewhere, is guilty of treason. Whoever, owing allegiance to the Sovereignty, forms any kind of relationship with the Kavai is in violation of this Article. The punishment for an act of treason against the Sovereignty is death.
Section II : Any person, Lonian or foreign, who has any knowledge pertaining to a commission of treason, conceals and does not, as soon as may be, disclose and make known the same to the Sovereignty, is guilty of misprision of treason. The punishment for misprision of treason is imprisonment lasting no less than 25 years.
Section III : Immunity Clause. Any person, Lonian or foreign, who reports a commission of treason to the Sovereignty, shall be granted judicial immunity and absolved of any association to the accused. (Civic Code 21.3.6)
Section IV : Coercion Clause. Evidence and/or testimony that the accused was forced to collaborate with the Kavai may be submitted for consideration. The claim will then be investigated thoroughly to verify legal standing. Evidence of testimony may only be considered before a confession or verdict have been obtained.
ARTICLE II
The Convention reflects the risk of acts of terrorism by Kavai influences as recognised by the Sovereignty.
Section I : The possession, custody, or control of assets originating from, supplied by, associated with, or reasonably traceable to Kavai sources is a level three security offense. Assets include, but are not limited to
weapons;
biological agents;
chemical substances;
devices; and
materials.
Section II : Anyone on soil governed by the Sovereignty found in possession of Kavai assets is guilty of a class three illegal possession (Counterterrorism Defense Act). All illegal assets are to be seized by the Fourth House and destroyed once sentencing is complete. The punishment for class three illegal possession is imprisonment lasting no less than 15 years.
Section III : Immunity Clause. Any person, Lonian or foreign, who reports illegal possession of Kavai assets to the Sovereignty, shall be granted judicial immunity and absolved of any association to the accused. (Civic Code 21.3.6)
Section IV : Coercion Clause. Evidence and/or testimony that the accused was forced to collaborate with the Kavai may be submitted for consideration.
